This agreement incorporates the terms and conditions for us to provide services to the User of this website (herein referred to as “the User”) and any person(s) availing services from us through this website shall be deemed to have read, understood and expressly accepted these terms and conditions, which shall govern the desired transaction or provision of such services by is for all purposes, and shall be binding on the User. All rights and liabilities of the User and/or us with respect to any services to be provided by us shall be restricted to the scope of this agreement.

We reserve the rights, in its sole discretion, to terminate the access to any or all our websites and the related services or any portion thereof at any time, without notice.

ACCEPTANCE OF AGREEMENT

You agree to the terms and conditions outlined in this Terms of Use Agreement (Herein referred to as the “Agreement”) with respect to our Site. This Agreement constitutes the entire and only agreement between us and you with respect to the Site and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you must review this Agreement prior to using the Site.

The following terms and conditions apply to all Travel provided by Travel Candy LLC through the website www.thetravelcandy.com (herein after referred to as “Travel Candy LLC”). For this purpose, the term “Travel” shall include any combination of hotels, resorts, excursions, tours, transfers, rentals, etc., that have been organized on your behalf by Travel Candy LLC.

If your booking includes flights, accommodations or other services, provided by someone other than Travel Candy LLC, then your contract shall be subject to the conditions set forth by that company, or in the case of an airline, the airline’s applicable booking conditions. These conditions do not affect your statutory rights.

Any arrangements which you make while on your vacations and which are not made through Travel Candy LLC are ones for which we have no responsibility or liability.

  1. Making a booking

When you make a booking with us, you undertake that you have the authority to accept and do not accept these booking conditions on behalf of yourself and your party. A contract will exist upon our accepting any money from you toward the booking or upon the issue of our confirmation or itinerary, whichever is the earlier. These conditions in conjunction with the information set out in our published information from the entire agreement between yourself and Travel Candy LLC.

When you make a booking with www.thetravelcandy.com and we accept it, the total cost of the package becomes due and payable immediately.

  1. Our Rates

 All rates are fixed at the time of the booking and generally will not be subject to any surcharges. The only exception will be an increase in our costs arising as the result of any government action including but not limited to, new or increased taxes such as VAT (Value Added Tax).

Upon receipt of payment, you will receive the following:

  1. Changes by You

If you require to make amendments to your booking in anyway after we have received your payment, and if we can accept the change, we reserve the right to charge $45.00 per person, per amendment provided that your instructions are provided in writing, and are received and acknowledged by us at least 7 days before tour departure for single day trips and 24 days before tour departure for multi day tours. Thereafter, except as provided by applicable law, cancelation charges as specified in Condition 7 below, shall apply.

  1. If you cancel your booking

You or any member of your party may cancel all or part of your travel at any time, provided that the cancelation is made in writing to us by the person who made the original booking. You will receive a refund of the amount paid (excluding any amendment charge) less the cancelation fees as specified below:

  • Cancelation fees are calculated based on the date we receive your signed Cancellation Request Form and travel service start date.
  • If a tour is scheduled to depart within the next 6 days, we will not change a traveller’s departure date and will not offer a refund.
  • All cancelations must be made directly with Travel Candy, not with tour providers.
  • In most cases, refunds processed by wire transfer, any associated wire transfer fee will be deducted from the overall refund amount.
  1. Refunds

The refund and cancellation fee policy takes effect once reservation is finalized and confirmation is received by the traveller. If your purchase cannot be confirmed for any reason, we will fully refund your purchase without any additional charges. We recommend each customer read and review the cancellation policy.
a) What CAN be Refunded:

  • Under very rare circumstance, some tours may be affected by natural disasters or other political related events. Affected travellers will be fully refunded or they may choose another product (i.e. new destination with similar price)
  • Please note that the product chosen by the traveller may be more expensive than the original product and may be subject to an additional cost.
  • Should we, for any reason, could not confirm the reservation, the traveller will receive full refund without additional charges.
  • All properly requested cancellation requests, provided that it is deemed eligible as mentioned in Condition 6.

b) What CANNOT be Refunded:

  • All hotel and tour schedules are arranged ahead of time. Any person failing to appear on the day of departure will not be refunded.
  • No refund will be given for any portions of the tour unused by the traveller after tour departure regardless of circumstances.
  • Hotel extensions and Instant Confirmation products (admission tickets, etc.) cannot be exchanged or refunded once confirmed.
  1. Force Majeure or Acts of God

During any vacation period, unforeseen events can take place, these events may include bot may not be limited to the following, terrorism, civil unrest, rioting, war, natural disasters, flood, typhoons or a nuclear disaster. These acts among others are referred to in the travel industry as FORCE MAJEURE, a French term meaning, “unforeseeable circumstances that prevent someone from fulfilling a contract”.

Let it be known that Travel Candy LLC will in no way be responsible for any booking, travel, airlines, vehicle transfer, boating transfer, hotel accommodations refund during a Force Majeure. It is highly advised that prior to your travel, that you acquire travel insurance to protect your interest. Proceed with your booking, only if you agree with our policy.

If we amend your booking

It is unlikely that we will have to amend your booked trips. However, occasionally, changes may become necessary which we reserve the right to make at any given time. Most of these changes are minor and we will advise you at the earliest possible date.

Confirmed dates will be as shown on your itinerary. Should a material change become necessary, we will inform you as soon as reasonably possible by email. You may decide whether or not to accept the change, however you must accept or reject the proposed change in writing via email within 72 hours of notification, otherwise, we will assume that you have accepted the proposed change. A material change is one made to your travel arrangements prior to departure, this involves substitution of hotel or accommodations originally booked with one of a lower grade.

IMPORTANT NOTICE: We are not responsible for changes which arise as a result of events outside of our control, such as technical or maintenance problems with transportation, war or threat of war, civil strife, industrial disputes, natural disasters, bad weather or terrorist activity.

If we cancel your booking

We reserve the right in any circumstance to cancel your booking. However, in no case we will cancel your booking less than 30 days prior to departure, unless it is for reasons outside of our control or for non-receipt of payment by you. If we do cancel your booking (other that for non-payment) we will offer you a full refund of all monies paid in respect of the booking.

Our Liability

Our obligations and those of our suppliers providing any service or facility involved in any part of your travel are to take reasonable skill and care to arrange for the provision of such services and facilities and, where we or our supplier is actually providing the service or facility, to provide them with reasonable skill and care. Compliance with any applicable regulatory requirements (if applicable, in the Country or municipality that they operate) will be proper performance of our, and our suppliers’ obligations. You must show that reasonable skill and care has not been used, if you wish to make any claim against us.

Documentation

Where travel and health documents are necessary to comply with the requirements of the country you may wish to visit, then it is YOUR RESPONSIBILITY to acquire them. If failure to obtain any such documents results in fines, surcharges or any other financial penalty being imposed upon us, then you agree to reimburse us accordingly. You must ascertain by consulting your own doctor, if necessary, the specific precautions deemed prudent for the country or destination you intend to visit and to ensure that the appropriate medication, inoculations or other precautions are taken.

Conditions of Carriage & Accommodations

We are neither a carrier nor a hotel accommodations provider. Each journey (whether undertaken or not) that you book by land, sea or air is governed by the conditions of the carrier undertaking to provide that carriage. Some of these conditions limit or exclude liability and are often the subject of international agreements. Copies of the applicable agreements are available for inspection at the offices of the carrier concerned.

It is your responsibility to re-confirm the onward or return sectors of any air journey with the carrier concerned or such carrier’s duly authorized agents and according to such carrier’s regulations. When you book accommodations (whether provided or not) its availability or provision is subject to the “house rules” of the hotel or other accommodation providing or undertaking to provide such accommodations.

Termination of your booking

We reserve the right in our absolute discretion to terminate your travel without notice should your behaviour be such that it is likely in our opinion, to cause distress, damage, annoyance or danger to any other person. In such circumstances, no refund or compensation will be due to you.

Unused Services

No refund will be due to you in respect to the non-utilization of any part of the travel arrangements made for you by Travel Candy LLC.

Travel Insurance

It is a condition of the agreement between us that you take out adequate vacation and travel insurance against cancelation charges, unexpected curtailment of your vacation, medical expenses arising overseas including repatriation, loss or damage to luggage and personal liability claims against you.

Should you fail to secure such travel insurance coverage prior to your travel in your chosen destination, then you accept full responsibility for yourself and all the members of your party, and indemnify Travel Candy LLC and our overseas travel agents and representatives (as applicable) for any and all costs that may arise, which would otherwise have been met, ha such travel insurance been in force.

Complaints

We do our VERY BEST to ensure that your travel arrangements go according to plan. However, if you have a complaint arising out of what we have agreed to provide for you, please let us know at the earliest possible opportunity. If a problem arises during your trip, please contact us immediately, so we may help you.

If your complaint cannot be resolved immediately, you should advise us within 30 days of the incident, in writing, by giving your booking number, a detailed description of your complaint and other relevant information and send it to us at wecare@thetravelcandy.com

Please note: Failure to follow our complaint procedure, we will not accept responsibility for your complaint, as we would have been deprived of the opportunity to investigate the matter on your behalf, and where possible, help you resolve the problem.

Applicable Law

Any contract or dispute between us and these terms and conditions are to be governed by and construed in accordance with the law of the Republic of Georgia. Both parties agree to submit to the exclusive jurisdiction of the Courts of Tbilisi, Georgia.

Effective Date

The effective date of this policy is 1st August 2019 and it replaces all prior Terms and Conditions issued by Travel Candy LLC. We reserve the right to change our policy at any time without prior notice.
